Abstract
This This research aims to know the legal relationship between the travel agency with a tour guide in a cooperation agreement, and traveling the responsibility against the travel agency tour guide who suffered losses (wanprastasi) in the tourism sector .This type of research is the study of normative approach by using method of empirical approaches to legislation, comparative approach.The legal relationship is born from the existence of agreements between tourism travel agency (travel agency) with a tour guide (tour guide), which gives rise to rights and obligations in the form of bonds.The responsibility of the tour operator (travel agency) against the tour guide (tour guide) that are experiencing losses caused the presence of tort conducted tours travel agency (travel agency) is a form of responsibility in the form of damages.Such damages include a refund equal to the losses experienced by its customers, replacing services similar or equivalent value, and provide compensation to consumers are harmed as a form of apology travel the Agency.
