Abstract
The purpose of this study is to determine the form of the agreement made by the parking manager with consumers and the responsibility of parking managers from the perspective of Law No.8 of 1999 on Consumer Protection. This study uses normative legal research methods and uses three approaches, namely the statutory approach, the conceptual approach, and the case approach. These three approaches emphasize the law as a doctrine or a set of normative rules, the experts' view, and the Supreme Court's decision regarding the responsibility of parking managers recently. The form of the agreement made between the parking manager and the consumer should be written. This agreement is a goods storage agreement. However, this agreement contained a standard clause that is detrimental to the interests of consumers. This can be seen from the legal considerations of the Supreme Court in decision No: 124 / PK / Pdt / 2007. The provisions stated in the parking ticket and on the board displayed in front of the entrance to the parking area constitute an agreement that contains legal defects due to the lack of freedom of the party accepting the clause. Supreme Court Decision No: 124/PK/Pdt/2007 provides compensation penalties for parking managers who neglect to carry out their duties. In this ruling, the Supreme Court punished the parking manager for compensation losses suffered by consumers. Thus the responsibility of the parking management must be borne by the parking manager.
