Abstract

This study aims to identify and understand clearly the Terms delay debt payment obligations in the decision number 05 / PKPU / 2013 / PN.Niaga. Surabaya by Act No. 37 of 2004 on bankruptcy and suspension of debt payments. The method used in this study is a normative legal research methods, namely research on library materials or secondary data, which consists of primary legal materials, secondary law and tertiary legal materials. Data collection through searches of documents and scientific books to get the theoretical foundation material in the form of positive law in accordance with the object to be examined. Data collection tool that is used in the form of dokumen.Teknik analysis used is qualitative analysis techniques. Based on the research results, it can be concluded that: 1) The applicant has more than one creditor and the applicant is experiencing delays in paying debts that have matured and can be billed. However, the applicant still has the ability to pay off its debts if given a grace period to delay payment. 2) Basic legal considerations the judges give a verdict endorsement of peace for all creditors unanimously approved a peace plan proposed by the debtor, so that a peace treaty. 3) The peace agreement binding on both the debtor and all creditors unsecured creditors and creditors separatists without exception. Furthermore, relations with all creditors of the debtor is no longer determined by the provisions of previous bilateral agreements, but governed by the terms and provisions of the peace agreement.
