Abstract

Tujuan penelitian ini adalah mengetahui persamaan dan perbedaan pengaturan hukum dan prinsip dasar yang menonjol terhadap Perpres No. 65 Tahun 2006 dengan UU No. 2 Tahun 2012. Jenis penelitian ini adalah penelitian normatif dengan pendekatan undang-undang, konseptual dan komparatif. Hasil penelitian diperoleh persamaan dan perbedaan pengaturan hukum mengenai pelaksanaan, durasi waktu pelaksanaan dan tahapan pengadaan tanah, serta prinsip dasar yang menonjol seperti penghormatan hak atas tanah, prinsip kemanusiaan, prinsip demokratis dan prinsip adil. Kesimpulan bahwa UU No. 2 Tahun 2012 merupakan penyempurnaan dari peraturan sebelumnya. Kata Kunci : Perbandingan, Pengadaan Tanah, Kepentingan Umum. ABSTRACT The purpose of this study was to determine the similarities and differences in the legal setting and the basic principles that stand against Perpres No. 65 Tahun 2006 with UU No. 2 Tahun 2012. This research is normative research approach legislation, conceptual and comparative. The results obtained by the similarities and differences in the legal arrangements concerning the implementation, execution duration and stages of land acquisition, as well as the basic principles such as respect for the prominent land rights, humanitarian principles, democratic principles and equitable principles. Conclusion that UU No. 2 Tahun 2012, an improved version of the previous rules.
